New procedure for compensating damage from man-made emergencies

Uzbekistan has approved a Regulation on the procedure for assessing and compensating damage caused to the population as a result of man-made emergencies; the relevant document has been published on the lex.uz portal. UzNews.uz reports on the adopted provisions.

Who will receive what and how much

A Compensation Fund will be established under the khokimiyats of all districts and cities of the republic, and the amount of compensation will be determined by a special commission in coordination with the territorial bodies of economy and finance. The Regulation provides for one-time material assistance in four categories: to family members of the deceased (spouses, children, parents and dependents) — up to 500 BRV, that is 220 million soums per family, with the amount distributed among family members in equal shares; to those who sustained severe bodily injuries — up to 200 BRV (88 million soums); moderate injuries — up to 150 BRV (66 million soums); minor injuries — up to 100 BRV (44 million soums).

Source of payments

The funds will be paid at the expense of legal entities or their officials found responsible for the occurrence of the emergency. Thus, financial liability falls directly on the party at fault rather than on the budget as a whole — while the mechanism for determining the amount remains with the local commission.
